1. Acceptance of Terms

By accessing or using the Driven By Dirt platform at drivenbydirt.com, including the website, mobile applications, and related services (collectively, the “Service”), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are a racing driver under 18, a parent or legal guardian must accept these Terms on your behalf and supervise your account. By using the Service, you represent that you meet these eligibility requirements.

3. Account Registration

To access certain features (such as uploading videos, listing merchandise, or accessing the Driver Garage), you must register for an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information.
Keep your password secure and confidential.
Accept responsibility for all activities under your account.
Notify us immediately of any unauthorised use of your account.

4. Subscriptions and Payments

Driven By Dirt offers free and paid subscription tiers (FREE, PRO Season Pass, and CREW membership). By subscribing to a paid tier you agree to:

Pay the recurring subscription fee as displayed at the time of purchase.
Authorise us to charge your payment method on a recurring basis until you cancel.
Accept that subscription fees are non-refundable except where required by law.

Crew members receive a 50% discount on the standard PRO Season Pass price as set out in the membership terms. Pricing is displayed in your local currency where supported (NZD, AUD, USD) and is subject to the lifetime cap announced on the Pilot Pricing page.

5. User Content

You retain ownership of content you upload (videos, photos, listings, setup notes, reviews). By uploading, you grant Driven By Dirt a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and create derivative works of your content for the purpose of operating and promoting the Service.

You are responsible for the content you upload. You must not upload content that is unlawful, infringing, defamatory, obscene, or that infringes the rights of any third party.

6. Driver Verification and Verification Badges

Drivers can apply for identity verification through the Driver Verifications process. Verification badges (“blue tick”) indicate that the platform has confirmed the driver's identity via the liveness check process. Verification may be revoked at any time if the platform determines that the verification is no longer valid.

7. Prohibited Conduct

You must not:

Impersonate any person or entity.
Upload content that infringes third-party intellectual property rights.
Use the Service to harass, abuse, or harm another person.
Attempt to bypass security measures or access non-public areas of the Service.
Use the Service for any unlawful purpose.
Scrape, crawl, or use automated means to access the Service without our written consent.

8. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users of the Service. You may cancel your account at any time via Settings.

9. Disclaimers and Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Driven By Dirt disclaims all warranties and shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
